The Paperitalo Publications, LLC website, http://44.204.181.223/ allows Customers to create individual profiles, which may include personal information (”Profiles”), and to make these Profiles, or resumes, they post public.  In addition, Paperitalo Publications, LLC may acquire information about you from publicly-available websites and may use this data to create a Profile or append it to an existing Profile.

Paperitalo Publications, LLC may revise these Terms at any time, without notice, by posting an updated version to this page. You should refer to this page from time to time in order to review the most contemporary Terms as they remain legally binding on you.

2. Terms Applicable to Employers.

Employers are solely responsible for their postings on Paperitalo Publications, LLC website. Paperitalo Publications, LLC is not to be considered to be an employer with respect to your use of any Paperitalo Publications, LLC website and Paperitalo Publications, LLC shall not be responsible for any employment decisions, for any reason, made by any entity posting positions on any Paperitalo Publications, LLC website.

You comprehend and acknowledge that if you cancel your employer account or your employer account is terminated, all your account information from Paperitalo Publications, LLC, including but not limited to, saved resumes, network contacts, and email mailing lists, will be marked as deleted in and may be deleted from Paperitalo Publications, LLC’s databases.

In order to protect our Paperitalo Publications, LLC’s customers from commercial advertising or solicitation, Paperitalo Publications, LLC reserves the right to restrict the number of e-mails which an employer may send to customers to a number which Paperitalo Publications, LLC deems suitable in its sole discretion. You shall use the Paperitalo Publications, LLC Networking and Profiles in accordance with all applicable privacy and data protection laws.

Position postings

A position posting will not contain:

(1) any hyperlinks, other than those expressly authorized by Paperitalo Publications, LLC;
(2) inaccurate, illegible, or “hidden” keywords, repeated keywords or keywords that are irrelevant to the career opportunity being presented, as determined in Paperitalo Publications, LLC’s discretion;
(3) the names, logos or trademarks of unaffiliated companies other than those of your customer save where specifically authorized by Paperitalo Publications, LLC;
(4) the names of colleges/universities, cities, states, towns or countries that are not germane to the posting;
(5) more than one position or job description, more than one location, or more than one job category, unless the product permits;
(6) inaccurate, deceptive, or misleading information; and
(7) material or links to material that exploits people in a racial, sexual, harassing, violent or other manner, or solicits personal information from anyone under 18.

You are not authorized to use your Paperitalo Publications, LLC job posting, Paperitalo Publications, LLC or Profiles to:
(1) post positions in a manner that does not abide with applicable local, national and international laws, including but not limited to, employment and labor laws, equal employment opportunity and employment eligibility requirements, data privacy, data access and use, and/or intellectual property;
(2) post positions that require citizenship of any particular country or lawful permanent residence in a country as a requirement of employment, unless otherwise mandated in order to comply with law, regulations, executive order, or federal, state, provincial or local government contract;
(3) post positions that include any screening qualification or test in connection with a job posting where such qualification or test is not an actual and legal prerequisite of the posted position; (4) with regard to Profiles, conclude a consumer’s eligibility for: insurance or credit for person, family, or household purposes; a government license of benefit; or employment.
(5) post positions or other advertisements for competitors of Paperitalo Publications, LLC or post jobs or other content that contains links to any site competitive with Paperitalo Publications, LLC;
(7) sell, promote or advertise products or services, unless authorized by Paperitalo Publications, LLC;
(8) post any franchise, pyramid scheme, “club membership”, distributorship, multi-level marketing opportunity, or sales representative agency arrangement;
(9) post any business opportunity that requires periodic or up-front payment or requires enlistment of other members, sub-distributors or sub-agents;
(10) post any business opportunity that pays commission only unless the posting explicitly states that the said job pays commission only and explicitly details the product or service that the job seeker would be selling;
(11) promote any opportunity that does not represent genuine employment which is customarily indicated by the employer’s use of IRS forms W-2 or 1099 in the United States or applicable equivalent documentation if the position is resident in another legal jurisdiction;
(12) advertise sexual services or seek employees for jobs of a sexual nature;
(13) solicit the use of human body parts or the donation of human parts, including, but not limited to, reproductive services such as egg donation, sperm and surrogacy;
(14) endorse a specific political party, political agenda, political position or issue;
(15) promote a specific religion;
(16) post positions located in countries subject to economic sanctions of the United States Government; and
(17) except where allowed by applicable law, post positions which obligate the applicant to provide information regarding his/her: racial or ethnic origin; political opinions; philosophical or religious opinions; trade union membership; physical or mental health; sexual lifestyle; age; or the commission of criminal offences or proceedings.

Paperitalo Publications, LLC retains the right to delete any job posting or content from any Paperitalo Publications, LLC website, which in the reasonable act of Paperitalo Publications, LLC’s discretion, does not comply with the above Terms and conditions, or if any content is posted that Paperitalo Publications, LLC trusts is not in the best interest of Paperitalo Publications, LLC.

If during your use of the Paperitalo Publications, LLC Services, you made a misrepresentation of fact to Paperitalo Publications, LLC, at any time, or otherwise deceived Paperitalo Publications, LLC regarding the nature of your business activities, Paperitalo Publications, LLC will have justification to terminate your use of the Paperitalo Publications, LLC Services without reimbursement of any fees or moneys paid to Paperitalo Publications, LLC, for any reason.

Resume Database

The following refers to the usage of the Paperitalo Publications, LLC Resume Database delineated by this name or any name Paperitalo Publications, LLC may use in the future as an archival repository by Employers.

You hereby agree that you will use the Paperitalo Publications, LLC Resume Database as set forth in these Terms and in any contract you have with Paperitalo Publications, LLC. You hereby agree that you will use the Paperitalo Publications, LLC Resume Database in accordance with all applicable privacy and data protection laws, and you agree you will not further disclose any of the data from Paperitalo Publications, LLC Resume Database to any third party, unless you are an authorized recruitment agency, staffing agency, advertising or other agency or using the resume explicitly for employment purposes only.

You hereby agree that you will take appropriate technical, physical and administrative measures to protect the data which you have obtained from Paperitalo Publications, LLC Resume Database from loss, misuse, unauthorized access, disclosure, alteration or destruction. You will not share Resume Database seat-based license login credentials with any other party whatsoever.

The Paperitalo Publications, LLC Resume Database will never be used:
(1) for any purpose other than as an employer seeking employees, including but not limited to advertising promotions, products, or services to any resume holders;
(2) to make unsolicited phone calls, emails, faxes or send unsolicited mail, email, or newsletters to resume holders or to contact any individual unless they have consented to be contacted (where consent is required or, if express consent is not required, who has not informed you that they do not want to be contacted); or
(3) to source candidates or to contact job seekers or resume holders in regards to career fairs and business opportunities prohibited herein.

In order to guarantee a safe and effective experience for all of our customers, Paperitalo Publications, LLC retains the right to limit the amount of data (including resume views) that may be accessed by you in any given time period. These limits may be amended in Paperitalo Publications, LLC’s sole discretion from time to time.

3. Terms Applicable to Job Seekers.

When you register with any Paperitalo Publications, LLC website, you will be asked to establish an account and provide Paperitalo Publications, LLC with certain personal information including, but not limited to, a valid email address (Your “Information”).

Any Profile you submit must be accurate and describe you, an individual living person. The Profile requires standard fields to be filled out and you may not include in these fields any telephone numbers, street addresses, email addresses or other means of contacting you, other than your last name and email address or URLs.

You acknowledge and agree that you are solely responsible for the form, content and accuracy of any resume or material contained therein placed by you on the Paperitalo Publications, LLC website.

Paperitalo Publications, LLC reserves the right to offer third party products and services to you in connection with the preferences that you describe in your registration and at any time thenceforth or you have agreed to receive, such offers may be made by Paperitalo Publications, LLC or by third parties, such as future employment newsletters or other offerings which may be of benefit. Please refer to Paperitalo Publications, LLC’s Privacy Policy, for additional details concerning your Personal Information and privacy.

You hereby understand, agree and acknowledge that you have no ownership rights in your account and that if you cancel your Paperitalo Publications, LLC account or your Paperitalo Publications, LLC account is terminated, all your account information from Paperitalo Publications, LLC, including resumes, Profiles, cover letters, saved jobs, questionnaires will be marked as deleted and may be deleted from Paperitalo Publications, LLC’s databases and will be removed from any public area of the Paperitalo Publications, LLC Sites. Furthermore, be advised, third parties, including, but not limited to potential employers, may keep saved copies of your Information without the knowledge of Paperitalo Publications, LLC. Paperitalo Publications, LLC reserves the right to delete your account and all of your Information after a significant period of inactivity.

4. Utilization of the Paperitalo Publications, LLC Services.

The job posting, resume database (“Paperitalo Publications, LLC Resume Database”) and other features of the Paperitalo Publications, LLC website may only be used by individuals searching for employment and/or career information and by employers searching for employees. Moreover, Paperitalo Publications, LLC Networking and Profiles shall only be used by individuals for granted professional and personal networking purposes. Further, your utilization of the Paperitalo Publications, LLC Services is subject to any other contracts or agreements which you may have with Paperitalo Publications, LLC. In the case of any dispute between these Terms and any contract or agreement you have with Paperitalo Publications, LLC, the Terms of your contract or agreement will prevail. The term “post” as used herein shall mean information that you submit, publish or display on Paperitalo Publications, LLC’s website.

You are responsible for protecting the confidentiality of your account, Profile and passwords, as applicable. You may not share your password or other account access information with any other party, temporarily or permanently, and you shall be responsible for all uses of your Paperitalo Publications, LLC website registrations and passwords, whether or not authorized by you. You agree to immediately notify Paperitalo Publications, LLC of any unapproved use of your account, Profile, or passwords. You further agree to hold Paperitalo Publications, LLC harmless from any liability in connection with any unauthorized use of your account, Profile or passwords.

All Paperitalo Publications, LLC customers hereby agree to not:
(1) disseminate, post, distribute, store or destroy material, including but not limited to Paperitalo Publications, LLC Content, in violation of any applicable law or regulation, including but not limited to laws or regulations governing the accumulation, processing, or transfer of personal information, or in breach of Paperitalo Publications, LLC’s privacy policy;
(2) undergo any activity that imposes an unreasonable or disproportionately large load on any Paperitalo Publications, LLC website’s framework;
(3) use any device to navigate or search any Paperitalo Publications, LLC website other than the instruments available on the website, generally available third party web browsers, or other instruments approved by Paperitalo Publications, LLC;
(4) use any data mining, robots or similar data gathering or extraction methods;
(5) breach or attempt to breach the security of any Paperitalo Publications, LLC website including, but not limited to, attempting to probe, scan or test the vulnerability of a system or network or to violate security or authentication measures without suitable authorization;
(6) fabricate any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting; reverse engineer or decompile any portion of any Paperitalo Publications, LLC website;
(7) aggregate, mirror or reproduce in any manner any of the Paperitalo Publications, LLC Content or information available from any Paperitalo Publications, LLC website, including, but not limited to expired position postings, other than as authorized by these Terms;
(8) frame or connect to any Paperitalo Publications, LLC Content or information available from any Paperitalo Publications, LLC Site, unless permitted by these Terms;
(9) post any content or material that advances or endorses misleading or false information or illegal activities, or endorses or provides instructional information regarding illegal activities or other activities forbidden by these Terms, including, but not limited to buying illegal weapons or ammunitions, violating someone’s privacy, providing or creating computer viruses or pirating media;
(10) post any resume or Profile or apply for any position on another party’s behalf;
(11) defer any contact from an employer to any agent, agency, or third party;
(12) set more than one copy of the same resume to public at any one time;
(13) share with a third party any login credentials to any Paperitalo Publications, LLC Site;
(14) access data not intended for You or logging into a server or account which You are not approved to access;
(15) post or submit to any Paperitalo Publications, LLC website any partial, false or inaccurate biographical information or information which is not Your own;
(16) post content that contains restricted or password-only access pages, or hidden pages or images;
(17) request passwords or personally identifiable information from other Customers, by any manner;
(18) remove or change any material posted by any other person or entity;
(19) harass, incite harassment or support the harassment of any group, company, or individual;
(20) transmit unsolicited mail or email, make unsolicited phone calls or send unsolicited faxes advocating and/or advertising products or services to any Customer, or contact any customers that have specifically asked not to be contacted by You;
(21) attempt to interfere with service to any Customer, host or network, including, but not limited to, via means of submitting a virus or malware to any Paperitalo Publications, LLC website, overloading, “flooding”, “spamming”, “mailbombing” or “crashing”;
(22) promote or endorse an illegal or unauthorized copy of another person’s copyrighted work, including, but not limited to, providing or making available pirated computer programs or links to them, providing or making available information to circumnavigate manufacturer-installed copy-protect devices, or providing or making available pirated music, video or other media or links to pirated music, video or other media files; or
(23) utilize the Paperitalo Publications, LLC Services for any unlawful purpose or any illegal activity, or post or submit any content, resume, or job posting that is slanderous, libelous, implicitly or explicitly offensive, vulgar, obscene, threatening, disparaging, repulsive, racist, sexist, discriminatory, of a menacing character or likely to cause annoyance, inconvenience, embarrassment, anxiety, stress or could cause harassment to any person or include any links to pornographic, indecent or sexually explicit material of any kind, as determined by Paperitalo Publications, LLC’s discretion.

Breaches of system or network security may result in civil and/or criminal liability. Paperitalo Publications, LLC will investigate instances which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting Customers who are involved in such violations to the fullest extent of the applicable law.

5. Customer Content and Compliance.

Both employers and job seekers hereby acknowledge and agree that all information, including, but not limited to, text, software, data, sound, music, graphics, video, photographs, advertisements, messages or other materials submitted, posted or displayed by you on or through a Paperitalo Publications, LLC website is the responsibility of the person from which said customer content commenced. Paperitalo Publications, LLC reserves no ownership rights or control over any customer content. You or a third party licensor, as appropriate, owns all patent, trademark and copyright to any customer content you submit, post or display on or through Paperitalo Publications, LLC and you are responsible for protecting those rights, as appropriate.

By posting, submitting, or displaying customer content on or through Paperitalo Publications, LLC, you grant Paperitalo Publications, LLC a worldwide, non-exclusive, royalty-free, conveyable, sub-licensable license to use, duplicate, adapt, distribute and publish said customer content through Paperitalo Publications, LLC. Furthermore, by posting, submitting, or displaying customer content which is designed to be available to the general public, you grant Paperitalo Publications, LLC a worldwide, non-exclusive, royalty-free license to duplicate, adapt, distribute and publish said customer content for the purpose of promoting Paperitalo Publications, LLC and its services. Paperitalo Publications, LLC will discontinue this licensed use within a reasonable period after said customer content is removed from Paperitalo Publications, LLC. Paperitalo Publications, LLC reserves the right to refuse to accept, post, display or transmit any customer content at its sole discretion.

You further authorize and represent that you have the right to grant, or that the holder of any rights, including moral rights in said content has absolutely and effectively waived all said rights and validly and irrevocably granted to you the right to grant, the license stated hereinabove. If you post customer content in any public area of any Paperitalo Publications, LLC website, You further permit any customer to access, display, view, store and duplicate said customer content for personal use. Subject to the aforementioned, the owner of said customer content placed on any Paperitalo Publications, LLC website retains any and all rights that may exist in said customer content. Paperitalo Publications, LLC may review and remove any customer content that, by its sole judgment, violates these Terms, applicable laws, rules or regulations, is disruptive, abusive, illegal, or offensive, or violates the rights of, or harms or threatens the safety of, customers of any Paperitalo Publications, LLC website. Paperitalo Publications, LLC reserves the right to permanently remove customers and prevent their future access to the Paperitalo Publications, LLC website and/or use of Paperitalo Publications, LLC Services for violating the Terms, applicable laws, rules or regulations. Paperitalo Publications, LLC may undergo any action with respect to customer content that it deems necessary or appropriate by its sole discretion if it believes that said customer content could create liability for Paperitalo Publications, LLC, damage Paperitalo Publications, LLC’s public image or brand, or cause Paperitalo Publications, LLC to be deprived of customers or, in whole or in part, the services of its ISPs or other suppliers.

Paperitalo Publications, LLC does not guarantee or represent the accuracy, reliability or  truthfulness, of any customer content, transmitted works from customer content, or any other communications posted by customers . Further, Paperitalo Publications, LLC does not endorse any opinions articulated by customers. You acknowledge and agree that any reliance on material posted by other customers is at your own risk.

The following customer content is prohibited, including, but not limited to:

• Content that is implicitly or explicitly offensive, such as customer content that engages in, endorses or promotes racism, bigotry, discrimination, hatred, sexism, or physical harm of any kind against any group or individual;
• Content that harasses, incites harassment or promotes the harassment of any group or individual;
• Content that involves the transmission of “spam calls”, “junk mail”, “chain letters,” or unsolicited mass mailing, “spamming” or “phishing”;
• Content that promotes or endorses false or misleading information or illegal activities or conduct that is abusive, threatening, obscene, slanderous, defamatory or libelous;
• Content that promotes or endorses an illegal or unauthorized copy of another person’s copyrighted work, including, but not limited to, providing or making available pirated computer programs or links to them, providing or making available information to circumvent manufacturer-installed copy-protect devices, or providing or making available pirated music, books, videos, or other media or links to pirated music or other media files;
• Content that contains restricted or password only access pages, or hidden pages or images;
• Content that displays or links to pornographic, indecent, immoral or sexually explicit material of any kind;
• Content that provides or links to material that exploits people of any age in a sexual, illegal, violent or other manner, or solicits personal information from anyone regardless of age; or
• Content that provides instructional information regarding any illegal activities or other activities prohibited by these Terms, including but not limited to, making or buying illegal weapons, violating someone’s privacy, stealing someone’s identity, providing or creating computer viruses or pirating any media; and
• Content that solicits passwords or personal identifying information from other customers.

Any Profile you submit shall describe you, an individual person. Inappropriate and prohibited Profiles include, but are not limited to, Profiles that allege to represent an animal, place, inanimate object, fictional character, celebrity, or real individual that is not you. You will not include, in any customer content submitted to Paperitalo Publications, LLC, information that may be understood to be a direct solicitation, advertisement or recruitment for an available job position directed to individuals seeking employment on either a full time or part time basis, unless authorized by Paperitalo Publications, LLC. In an effort to protect our Paperitalo Publications, LLC customers from commercial solicitation or advertising, Paperitalo Publications, LLC reserves the right to restrict the number of e-mails or other messages which a customer may send to other customers to a number which Paperitalo Publications, LLC deems appropriate at its sole discretion, and which may change from time to time.

Profiles derived from customer content may further be made available through the Paperitalo Publications, LLC website. Paperitalo Publications, LLC does not make any representations with regards to the validity or accuracy of said derived works or their suitableness for evaluation by employers. Derived Profiles may be substantially different from customer content. We appreciate our customers and welcome your comments concerning our services and the Paperitalo Publications, LLC website. However, please be aware, that our policy does not permit us to accept or consider suggestions, creative ideas, materials or inventions other than those that we have explicitly requested. When providing feedback regarding our services, please try to be specific in your comments and do not offer creative ideas, inventions, suggestions, or materials. However, if you send us creative suggestions, ideas, drawings, concepts, inventions, or other information (collectively the “Tendering”), the Tendering shall be the sole property of Paperitalo Publications, LLC. None of the Tendering will be subject to any requirement of confidentiality on our part and you hereby agree that we will not be liable for any use or disclosure of any Tendering. Paperitalo Publications, LLC shall own exclusively all now known or later discovered rights to the Tendering and shall be entitled to unrestricted use of the Tendering for any purpose whatsoever, commercial or otherwise, without compensation to You or any other person.

6. Paperitalo Publications, LLC’s Liability.

The Paperitalo Publications, LLC website act as, among other things, venues for employers to post job opportunities and search for and evaluate job candidates and candidates to post resumes and Profiles and search for and evaluate job opportunities. Paperitalo Publications, LLC does not censor or screen the listings, including Profiles submitted. Paperitalo Publications, LLC is not involved in, and does not control, the actual transaction between employers and candidates.
